TERMS OF LET
RENTAL ACCOMMODATION TERMS AND CONDITIONS

Please ensure that you read and understand the following terms and conditions pertinent
to your accommodation rental as these form part of the Contract between yourself
and us. They may seem a bit lengthy but are there to safeguard you as our guest.
If you have any queries please do not hesitate to contact
us.

PRICES

Whilst we reserve the right to increase or decrease accommodation prices at any time,
we will confirm to you the current price at the time of booking. As soon as you
have confirmed your booking and we have received your deposit or full payment,
the cost of the rental is guaranteed against any further increase, unless the
increase is brought about by Government action. This guarantee is offered
subject to our conditions of payment being adhered to and providing that you do
not make any further amendment to your booking.


Your holiday home rental includes accommodation as booked, services e.g. water and
electricity and US Sales and Tourist taxes.

You are required by Florida law to register your details within 24hrs of arrival with the management company Contempo


 NOT INCLUDED in our rental prices

a) Flights b) Car Hire c) Holiday Insurance d) Pool Heating – if required this will
be charged at the current rate. The villa will be cleaned prior to your arrival.
If you wish a mid-stay clean this will be charged at the current
rate.

1. BOOKING AND PAYMENT

a) DEPOSIT

To Confirm the booking, a deposit of 20% of the total amount is required. Upon
receipt of the deposit/clearance of the cheque, we will confirm the booking.
This is normally done via email. You must check the confirmation carefully and
raise any queries immediately.


b) PAYING YOUR BALANCE

The balance of the rental fee is due no later than 10 weeks prior to the
commencement of the rental period. For bookings within 10 weeks of the
commencement of the rental period the full amount is due. We reserve the right
to treat the booking as cancelled if we do not receive the balance by the due
date. In the event of a cheque not being honoured by the bank on which it is
drawn we will make a charge of £10.00/$15 to cover our costs.


c) SECURITY DEPOSIT

A Security indemnity insurance is to be purchased upon arrival and check in with the management company
accidental Damage Waiver – Non-Refundable
 
Damage waiver fee for stays:  Up to 28 nights                             $55.00                         
                                                 28 nights or more                         $100.00
                                        
For the once only payment shown above, Contempo Florida Holidays will waive liability up to $750.00 for minor inadvertent damages or breakages to this home. This will typically include, but is not limited to:
 
1.     Breakages to crockery, glasses  and lamps
 
2.     Removable stains on carpets due to spilt beverages or food
 
3.     Broken windows / pool screens
 
 
Exclusions: Intentional acts, misuse of pool equipment, gross negligence and or willful and wanton conduct. Tampering and removal/damage of pool equipment or patio door safety alarms.


 d) HOW TO PAY

can also be made directly into our UK or US Bank Accounts. Please note that any
Bank charges are to be paid by yourself.


2. CANCELLATION

In the event that you cancel your booking for any reason whatsoever, the following
charges will apply:

We strongly advise that you take out holiday Insurance to cover
cancellation.

The owners may in exceptional circumstances cancel the contract in whole or in part
without penalty. In such case, if the contract is cancelled before its
initiation, the client will receive full reimbursement of all monies paid
without interest or compensation. In such circumstances the owners accept no
liability whatsoever for any loss or damage sustained by the client.


3. ALTERATIONS TO BOOKING

If, after your booking has been accepted, should you wish to alter your arrangements
we will do all we can to help but an administration charge of up to £20/$30
may be charged.


4. RENTAL PERIOD

The rental period begins at 4pm on the day of arrival. The property must be vacated
by 10 am on the day of departure, unless otherwise agreed. Failure to comply may
result in an additional charge levied against the Security Deposit for late
departure.


5. SUB-LETTING

The accommodation is reserved exclusively for the number of persons specified in the
booking. No other persons are permitted to stay unless this has been agreed with
the Owners. Ages of children must be disclosed on booking
form

6. PARKING

In accordance with the rules of the Hampton Lakes Homeowners Association,
vehicles must not be parked on-street overnight and no truck or van, boat,
trailer, recreational vehicle, commercial vehicle or other types of non
passenger vehicle, equipment, implements or accessories shall be parked, stored
or otherwise kept on any portion of the property or elsewhere on Hampton
Lakes


7. SAFETY

The owners of the property or their agents cannot accept any responsibility,
whatsoever and howsoever caused, for injury or damage caused as a result of the
use of the pool, the surrounding area and the facilities of the villa. Guests
are specifically requested not to allow unsupervised children to use the pool
and no glassware should be taken outside to the pool
area.

8. FORCE MAJEURE

The owners of the property or their agents will not be liable for any loss or delays
occasioned by any of the following: Strikes, political unrest, hostilities, war
or threat of war, terrorist activity, industrial disputes, fire, flood,
technical/weather problems with transport, aircraft grounding, closure of
airports or ports, weather conditions or any other event beyond the owners or
agents control.


9. CONSTRUCTION DISCLAIMER

Hampton Lakes where our villa is situated has been fully completed however we
cannot guarantee that there will be no construction activity in the area. If we
know about any building work in the area at the time you make your reservation
which is likely to affect your stay we will make every effort to inform you of
this and endeavour to describe the current state of affairs, therefore no
refunds will be issued due to construction activity.


10. COMPLAINTS

In the unlikely event you should experience a problem or have a complaint about our
villa or its facilities you must contact our Management Company at the earliest
opportunity to enable them to investigate and attempt to solve the problem.
Please remember we are only human and cannot attempt to put something right if
we are not aware of the problem.

11. SMOKING POLICY

No smoking is permitted inside the villa. If this policy is not adhered to, a
$500 charge will apply for deep cleaning of the rental property.

12. PET POLICY

 Pets are not permitted in the villa. If this policy is breached, we reserve
the right to terminate the rental agreement immediately, with no refunds. A
charge of $500 will be applied for deep cleaning of the rental
property


 13. POOL

The pool will be a major part of your Florida holiday – please use and enjoy it.
However, we the owners or our agents accept no responsibility for accidents or
mishaps which may occur whilst using the pool or deck area. In the unlikely
event of the pool/spa heating malfunctioning (where pool/spa heating has been
ordered and paid for) we will refund the unusable portion of the pool heating
charge. Pool heating is recommended between November and April (but is not
compulsory) and can be provided throughout the year. Use of the pool blanket
will help to conserve the heat in the pool. Once the pool heating has been
ordered and paid for, no refund will be given if you change your mind and decide
not to have the pool heated.


14. LIMITATION OF LIABILITY

The owners, management company or agents accept no responsibility for any third
party claims for accidents, damage or loss of personal property, or for any
expenses incurred for any reason, including any incurred as a result of Force
Majeure. Please ensure that you have adequate travel insurance in
place.


15. FLORIDA WEATHER


Florida is a tropical country and therefore experiences occasional extreme weather
conditions, including thunderstorms, lightning and heavy rainfall. Storms are
common in the season from June to October. If you do experience a bad
thunderstorm do not swim in the pool. Turn off TVs, videos, electronic games and
wait for the storm to pass. Occasionally power outages may occur which can cause
interruptions to services such the as telephone, pool heating etc. If this
happens please notify our Management Company promptly. As the weather is totally
out of our control, no refunds will be issued due to problems caused by adverse
weather conditions.


16. FLORIDA WILDLIFE


Due to the climate, Florida does have lots of wildlife not found in the UK. The heat
and rain often brings bugs, insects and ants. To deter these creatures please
always clear away any scraps of food from the pool deck area, kitchen work
surfaces and floors. Store most food in sealed containers in the fridge as this
is sealed. Store other food in the high cupboards rather than the floor
cupboards. Make sure all external doors and windows are kept closed at all times
as some of these bugs fly and can get through any opening. No doors or windows
should be left open as the villa is air conditioned throughout. Open doors and
windows hinder the operation of the air conditioning and can cause damage due to
hot air hitting the operating system.


17.  Pool Screen and child safety fence

Do not lean the pool safety fence against the pool screen, please lay the safety fence on the floor, as leaning it against the screen will damage the screen and the cost will be incurred by yourself, at approx $80 per screen
